Introduction
This mobile application (“app”) is made available to you by the Ministry of Health of the government of Belize (“MOH” or “we” or “our”).
This app is for use as part of the MOH’s health and safety protocols put in place to mitigate against the spread of the COVID-19 Pandemic. This app is meant to provide assistance and information to you for your protection and so that you know your obligations under, and that you are able to comply with, these health and safety protocols. An important feature of this app is that it uses location services to track your location and movements while you are in Belize.
Please read these terms of use carefully. By using this app you confirm that you agree to be bound by these terms. If you do not agree to these terms you must immediately uninstall the app and discontinue its use. These terms should be read alongside our privacy policy.
Variations
The MOH may from time to time vary these terms without prior notification. Please check these terms regularly to ensure you are aware of any variations made by us. If you continue to use this app you are deemed to have consented to and accepted any variations made by us. If you do not agree to any variations then you should discontinue your use of the app.
Use of the App
The MOH grants you a non-exclusive, non-transferable, revocable licence to use the app for your personal, non-commercial use as permitted by these terms. In the event you breach these terms we will be entitled to immediately terminate this license and discontinue your use of the app.
Intellectual Property
The MOH’s name and logo, and any other of our trademarks, service marks, graphics and logos used in connection with this app are trademarks of the MOH. Our trademarks, logos, service marks and graphics may not be copied, imitated or used, in whole or in part, without our prior written permission. This app and the contents featured in this app are protected by copyright, trademark, and other intellectual property laws, and this app and contents are the sole property of the MOH.
Prohibited Uses
You agree not to use this app in any way that is unlawful, illegal or unauthorised; is defamatory or injurious of any other person, including the MOH; is obscene or offensive; promotes any form of discrimination; infringes any copyright, database right or trade mark of the MOH or any other person; or is likely to disrupt or interference with our services in any way.
No Promises
The MOH provides this app on an ‘as is’ and ‘as available’ basis without any promises or representations as to the accuracy, completeness, currency or reliability of any content available in this app. You are solely responsible for verifying any information contained in this app before relying on it and the use of this app and reliance on its contents is at your sole risk and we assume no responsibility or liability for your use. To the fullest extent permitted by applicable law, we exclude all promises, whether expressed or implied, including any promises that this app is fit for purpose, of satisfactory quality, non-infringing, is free of defects, is able to operate on an uninterrupted basis, that the use of the app by you is in compliance with local or international laws or that any information that you transmit in connection with this app will be successfully, accurately, securely or privately transmitted.
Exclusion of Liability
Use of this app is at your sole risk. The MOH expressly and specifically disclaims and excludes any and all liability, whether based on contract, tort, strict liability, breach of privacy or other rights, or otherwise whatsoever and howsoever, without limitation, and for any direct, indirect, incidental, consequential or special damage, arising out of or in any way connected with the access or use of this app, even if we have been advised of the possibility of damage. This includes but is not limited to claims based on the reliance on any content obtained or transmitted through this app; or any privacy related claims or claims related to unauthorized access or use of this app or the information provided in the app, including your personal information; or claims related to any mistakes, omissions, delays or errors in information transmitted to or from you.
This app uses location services to track your location and movements while you are in Belize. By using this app you consent to our use of this tracking feature, and you waive and release us from any liability whatsoever for any claim for infringement of privacy rights.
General
These terms are governed by the laws of Belize, and you agree to submit to the exclusive jurisdiction of the courts of Belize.
If any provision (or part of a provision) of these terms are found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, then that term, condition or provision will be severed and the remaining terms of this document will continue to be valid and remain in full effect.
If there is any conflict between these terms and the terms of use of your mobile service provider or any other terms of use connected with your device then these terms will apply.
